Translation - English FORM FOR NOTIFICATION OF THE RIGHTS OF A PERSON TAKEN INTO CUSTODY FOR DRUG TRAFFICKING
The information below should be given to you in a language you understand.
You are informed that you have been taken into police custody in the context of a procedure relating to drug trafficking acts, because there are one or more plausible grounds to suspect that you have committed or attempted to commit that offence. You will be questioned about these acts during the police custody, which may last for twenty-four hours. At the end of this period, the public prosecutor or the judge may decide on an extension of the police custody for a further period of twenty-four hours. Exceptionally, and if the requirements of the inquiry or investigation require it two additional extensions, for a period of twenty four hours each, can be ordered by the remand judge at the request of the prosecutor or the investigating judge. However, if the anticipated length of time for the investigation still to be completed at the end of the first forty eight hours so justifies, the remand judge may at the request of the prosecutor or investigating judge decide that the custody will be extended once only for a forty eight hour period. At the end of police custody, you will, at the decision of the prosecutor or investigating judge, be brought before this magistrate, to be set at liberty.

To inform someone close to you and your employer and, if appropriate, your guardian or trustee and the consular authorities of the country of your nationality. You can ask to inform, at the latest within three hours and by telephone, a person with whom you usually live, one of your direct relatives, one of your siblings and your employer, and where appropriate your guardian or trustee or the consular authorities (in terms of your declared nationality), that you have been taken into police custody. The prosecutor or investigating judge may, however, oppose the application on the grounds of the investigation’s requirements.
To be examined by a doctor. You can ask to be examined by a doctor at the beginning of the police custody and on any extension of the measure. In the case of a first additional extension, you must be examined by a doctor and you will be notified of your right to seek a further medical examination.
To be represented by a lawyer. At the beginning of custody and, at the beginning of any extension of police custody, you can ask to be represented by a lawyer of your choice.
If you are unable to appoint a lawyer or the lawyer chosen cannot be contacted, you may ask to be represented by a court-appointed lawyer. This right to representation enables you to benefit from: -a confidential interview lasting thirty minutes,
-to be represented by a counsel at the hearings and arguments.
The intervention of the lawyer may, for compelling reasons particular to the circumstances of the investigation be postponed by the prosecutor or investigating judge.
