English to Spanish: Argentinian Supreme Court ruling concerning amnesty laws
Source text - English The Supreme Court confirmed that these amnesty laws had lost all pretence to legitimacy since, by obstructing the investigation and appropriate punishment of actions contrary to the rights recognised in the treaties, “they prevent the Argentinian state from complying with its commitment to guarantee these rights and are therefore inadmissible”.
The Supreme Court’s ruling also declared: “any internal legal regulation, supposedly introduced for reasons of pacification, which brings with it the granting of some form of amnesty that leaves unpunished grave violations against human rights perpetrated by the regime benefiting from it, is contrary to clear and obligatory undertakings in international law, and must be effectively suppressed”.
Furthermore, as quoted in the Barrios Altos judgement from the Interamerican Court of Human Rights “the promulgation of a law manifestly contrary to the obligations accepted by the State which is party to the Convention constitutes per se a violation of this and calls upon the State’s international responsibility”.
The Supreme Court, following the doctrine of the Interamerican Court of Human Rights, declared that the suppression of the Laws of the End Point and Due Obedience could not therefore be delayed; and that it should be carried out in such a way as to brook no judicial obstacle to the pursuit of these crimes.
Translation - Spanish La Corte Suprema de Justicia Nacional confirmó que estas leyes de amnistía habían perdido toda relevancia en cuanto a su legitimidad pues, al obstaculizar el esclarecimiento y la correspondiente sanción de los actos contrarios a los derechos reconocidos en los tratados, “impiden al estado argentino que cumpla con su deber de garantizar estos derechos y son, por lo tanto, inadmisibles”.
El fallo de la Corte Suprema de Justicia Nacional fue: “toda regulación de derecho interno que, invocando razones de pacificación, disponga la concesión de cualquier forma de amnistía que deje impunes las violaciones graves a los derechos humanos perpetradas por el régimen al que la disposición beneficia, es contraria a las disposiciones claras y obligatorias del derecho internacional, y debe ser efectivamente suprimida”.
Además, como se cita en la sentencia Barrios Altos de la Corte Interamericana de Derechos Humanos: “la promulgación de una ley manifiestamente contraria a las obligaciones asumidas por el Estado que es parte en la Convención constituye per se una violación de ésta y apela a la responsabilidad internacional del Estado”.
La Corte Suprema de Justicia Nacional, siguiendo la doctrina de la Corte Interamericana de Derechos Humanos, declaró que la supresión de la Leyes de Punto Final y de Obediencia Debida no podía, por lo tanto, ser postergada; y que debería llevarse a cabo de tal manera que no se admitiera ningún obstáculo jurídico en la persecución de estos delitos.
