Source text - English a) In the event that SUPPLY SYSTEM is damaged during this contract's validity, understanding damage as partial or total tank usage inability, the CONSUMER will pay respective amount to SUPPLlER in connection to the lowest quotation as obtained by the SUPPLlER for a same characteristics tank from at least one external supplier as of damage occurrence date. The CONSUMER will pay to the SUPPLlER the price of said SUPPLY SYSTEM within a term of 90 (ninety) days considered as of damage occurring date.
b) In the event that the CONSUMER incurs in delays in connection to obligation as established in previous paragraph, will pay to the SUPPLlER without requiring any judicial order all those respective financing expenses pursuant to this contract's established "Late Payments Interest Rate".
c) The CONSUMER must inform the SUPPLlER within a term of 24 (twenty four) hours after acquiring knowledge of any risk which could affect the SUPPLY SYSTEM and/or respective accessories, such as strikes, labor interruptions, embargo risks, or any other endangering SUPPLlER'S property, and will also assume upon the SUPPLlER respective responsibilities should any of these events occur.
Translation - Spanish a) En caso de que el SISTEMA DE SUMINISTRO sea dañado durante la vigencia de este contrato, entendiéndose como daño la inhabilidad para su uso ya sea parcial o total del tanque, el CONSUMIDOR pagará la cantidad respectiva al PROVEEDOR con respecto a la cotización más baja obtenida por el PROVEEDOR para un tanque de las mismas características de por lo menos de un proveedor externo para la reparación de cuando ocurrió dicho daño. El CONSUMIDOR le pagará al PROVEEDOR el precio de dicho SISTEMA DE SUMINISTRO dentro de un término de 90 (noventa) días considerados desde la fecha en que ocurrió dicho daño.
b) En caso de que el CONSUMIDOR incurra en demoras con respecto a la obligación tal como se estableció en el párrafo anterior, este le pagará al PROVEEDOR todos esos gastos de financiamiento respectivos según se establece en este contrato en la "Tasa de Interés de Pagos Tardíos", sin requerir ninguna orden judicial.
c) El CONSUMIDOR debe informar al PROVEEDOR dentro de un plazo de 24 (veinte cuatro) horas después de tener conocimiento, de cualquier riesgo que pudiera afectar el SISTEMA DE SUMINISTRO y/o de sus respectivos accesorios, tales como huelgas, interrupciones laborales, riesgos de embargos, o cualquier otro riesgo que ponga en peligro la propiedad del PROVEEDOR, y al mismo tiempo el PROVEEDOR asumirá bajo su respectiva responsabilidad cualquiera de estos acontecimientos que ocurran.
