Source text - French Par lettre en date du 6 mai 2005, le procureur de la plaignante adressait la réclamation suivante au procureur de la Banque :
« Cher confrère,
Relativement au dossier mentionné en rubrique, pour faire suite à la décision rendue le 12 avril 2005, par l’arbitre, notre cliente, Madame K, nous a donné instruction de vous informer qu’elle réclame à votre cliente, la Banque, d’une part, une indentification de 114 384,10 $, sauf à parfaire, à titre de réparation ou dommages, en raison du congédiement illégal, fait de façon injustifiée et sans cause raisonnable, dont elle a été victime, et en raison des faits entourant ledit congédiement, qui a été annulé par l’arbitre.
D’autre part, notre cliente réclame aussi à la Banque, que la lettre de congédiement et tous les documents et/ou rapports et/ou témoignages ou déclarations et/ou toutes pièces, incluant tout support informatique et/ou d’enregistrement et/ou cassettes ou cd, et leur contenu, la concernant et ayant trait ou découlant des faits qui ont entouré les événements et l’enquête sur celle-ci et son congédiement, soient détruits et par-là, exclus de son dossier d’employé, comme n’ayant jamais existé, et de plus, il lui soit fourni une lettre de recommandation ou de référence attestant son titre d’emploi et sa durée, ainsi que ses qualités et compétences, alors qu’elle était à l’emploi de la Banque, et jusqu’à son départ volontaire, ladite lettre devant être agréée quant à son contenu par Mme K, notre cliente.
Cette réclamation de 114 384,10 $, sauf à parfaire, s’établit comme suit :
a) Perte de salaire, primes et bonus, avantages sociaux, indemnité ou prime de départ : 35 000,00 $
b) Perte de réputation et/ou de compétence, perte de promotion, d’avancement prévisible, soit chez l’employeur ou encore, selon le cas, chez tout autre employeur dans une activité reliée à son domaine professionnel, perte d’expectative d’emploi, de rémunération intéressante reliée à ses compétences professionnelles, perte de carrière, de promotion et de rétribution comparable qui se retrouve dans son champ d’emploi, empêchement et retard dans la recherche d’emplois convenables dans son domaine, occasionné par la suspension et les allégations de la Banque, et ce, depuis la suspension et l’avenir : 30 000 $
c) Dommages moraux, inconvénients, conséquences financières et/ou économiques (crédit affecté), perte de convivialité, perte de confiance, stress, anxiété et autres dommages matériels (Taxis…) : 10 000 $
d) Atteintes à son intégrité, sa dignité, à sa personne et à sa réputation : 15 000 $
e) Frais d’avocats en honoraires et déboursés pour la défense de ses droits et autres frais juridiques : 24 384,10 $, sauf à parfaire.
De plus, notre cliente réclame à l’encontre de la Banque une ordonnance à l’effet que ses représentants et ses préposés ne puissent dévoiler, ni divulguer quelque fait relativement à ce congédiement et aux faits qui l’entourent et à l’effet que la seule information que ceux-ci puissent fournir se limite au contenu de la lettre de recommandation agréée, attestant ses états de service antérieurs, comme mentionné plus haut, sous peine de droit.
Translation - English By letter dated May 6, 2005, counsel for the complainant served the following claim to counsel for the Bank:
[TRANSLATION]
“Esteemed colleague,
With respect to the case mentioned above, following the decision rendered by the adjudicator on April 12, 2005, our client, Ms. K, has instructed us to inform you that she claims against your client, the Bank, firstly, indemnification in the amount of $114,384.10, subject to adjustment, for reparation or damages, resulting from an unlawful and unjust termination of employment without reasonable cause, of which she was victim, and resulting from the facts surrounding such termination, which was annulled by the adjudicator.
Secondly, our client also demands that the Bank destroy, and therefore exclude from her employee file as if never existed, the letter of termination and all documents and/or reports and/or testimony or declarations and/or all evidence, including any computer or recording medium, and any content regarding her, and regarding or arising from the events and the investigation concerning her and the termination of her employment. Moreover, our client demands that be provided to her a letter of recommendation or reference attesting the title of her position and duration of employment, her qualities and her competencies at the time of her employment at the Bank and until the time of her voluntary resignation. The content of the letter must be agreed to by Ms. K., our client.
This claim in the amount of $114,384.10, subject to adjustment, has been determined as follows:
a) Loss of salary, premiums and bonuses, employee benefits and severance payments: $35,000.00
b) Loss of reputation and/or skills, loss of promotion, foreseeable advancement, either with the employer or, as may be the case, with any other employer in a position related to our client’s field of work, loss of employment prospects, loss of remuneration commensurate with her professional skill level, loss of career, promotion and comparable pay to what can be found in her field of work, impediments and delays in her search for suitable employment in her field, caused by her suspension and the allegations of the Bank, from the time of the suspension until now and in the future: $30,000.00
c) Moral injury, inconvenience, financial and/or economic consequences (impact on credit rating), loss of social network, loss of confidence, stress, anxiety and other material damages (taxis…): $10,000.00
d) Damages to our client’s integrity and her dignity, trespass to her person and injury to her reputation: $15,000.00
e) Lawyers’ fees and costs for the defence of our client’s rights and other legal fees: $24,384.10, subject to adjustment.
Our client additionally seeks against the Bank an order prohibiting its representatives and employees from revealing or divulging any facts related to her termination or surrounding circumstances, or any information not contained in the approved recommendation letter attesting her previous employment, as mentioned above, under penalty of law.
