Cláusulas transitorias y disposiciones finales
ARTÍCULO 89. — La ley 19.798 y sus modificatorias sólo subsistirá respecto de aquellas disposiciones que no se opongan a las previsiones de la
presente ley.
ARTÍCULO 90. — Alcance. Decreto 62/90. La definición del artículo 6° inciso c) de la presente comprende los aspectos de la definición establecida
en el Pliego de Bases y Condiciones para el Concurso Público Internacional para la Privatización de la Prestación del Servicio de Telecomunicaciones
aprobado mediante el decreto 62/90.
ARTÍCULO 91. — Integración del FFSU. Establécese que en virtud de lo dispuesto por las Cláusulas 11.1 y 11.2 del Contrato de Fideicomiso de
Administración del Fondo Fiduciario del Servicio Universal decreto 558/08, los recursos del mismo previstos en el artículo 8° del Anexo III del decreto
764/00 y sus modificatorios quedarán integrados al Fondo del Servicio Universal creado por artículo 21 de la presente ley, en las condiciones que
determine la Autoridad de Aplicación.
ARTÍCULO 92. — Derogación. Derógase el decreto 764/00 y sus modificatorios, sin perjuicio de lo cual mantendrá su vigencia en todo lo que no se
oponga a la presente ley durante el tiempo que demande a la Autoridad de Aplicación dictar los reglamentos concernientes al Régimen de Licencias para
Servicios de TIC, al Régimen Nacional de Interconexión, al Régimen General del Servicio Universal y al Régimen sobre la Administración, Gestión y
Control del Espectro Radioeléctrico.
ARTÍCULO 93. — Régimen de transición. Licencias. A los actuales licenciatarios, operadores, prestadores y autorizados bajo el régimen instituido en el
decreto 764/00 y sus modificatorios se les aplicará el régimen previsto en la presente.
Al momento de la sanción de la presente, y sin más trámite, los títulos habilitantes actualmente denominados ‘Licencia Única de Servicios de
Telecomunicaciones’ serán considerados a todos los efectos ‘Licencia Única Argentina Digital’, sin mutar en su contenido, alcance y efectos.
La Autoridad de Aplicación podrá establecer regímenes y programas especiales tendientes a la regularización de situaciones de prestación cuyos
responsables no cuenten con la licencia correspondiente, contemplando a tal efecto la situación particular de cada actor involucrado garantizando la
continuidad de la prestación de los Servicios de TIC, sin que ello implique saneamiento de situación irregular alguna.
ARTÍCULO 94. — Los prestadores del Servicio Básico Telefónico, cuya licencia ha sido concedida en los términos del Decreto N° 62/90 y de los
puntos 1 y 2 del artículo 5º del Decreto N° 264/98, así como los del Servicio de Telefonía Móvil con licencia otorgada conforme el pliego de bases y
condiciones aprobado por Resolución del entonces MINISTERIO DE ECONOMÍA Y OBRAS Y SERVICIOS PÚBLICOS Nº 575/93 y ratificado por
Decreto N° 1461/93, sólo podrán prestar el servicio de Radiodifusión por suscripción, mediante vínculo físico y/o mediante vínculo radioeléctrico,
transcurridos DOS (2) años contados a partir del 1° de enero de 2016. El ENACOM podrá extender dicho plazo por UN (1) año más.

Provisional clauses and final provisions
ARTICLE 89.- Law 19,798 and its amendments shall only remain valid regarding such provisions that are not in conflict with the provisions of this law.
ARTICLE 90.- Scope. Executive Order 62/90. The definition of article 6º, c) of this law includes the aspects of the definition provided for in the Bidding Terms and Conditions for the Internal Public Tender for the Privatization of the Telecommunications Services, approved by executive order 62/90.
ARTICLE 91.- Universal Service Trust Fund (FFSU, as per its Spanish acronym) Integration. By virtue of Clauses 11.1 and 11.2 of the Trust Agreement of Universal Service Trust Fund Management 558/08, the resources provided for in article 8º of Annex III of the executive order 764/00 as amended shall be integrated into the Universal Service Fund created by article 21 of this law, in the terms to be established by the Applicable Authority.
ARTICLE 92.- Revocation. Executive Order 764/00 as amended is revoked; however, it shall remain valid in all that is not in conflict with this law for the term the Applicable Authority requires to issue the regulation regarding the Licenses System for TIC Services, the National Interconnection System, the General Universal Service System and the System on Radio electric Spectrum Administration, Management and Control.
ARTICLE 93.- Transition System. Licenses. Current licensees, operators, providers and authorized parties under the system created in executive order 764/00 as amended, the system provided for in this law shall be applied.
At the time of enacting this law and without further diligences, the operating permits currently referred to as “Telecommunications Services Sole License” shall be named for all effects as “Argentine Digital Sole License”, without modification to its content, scope and effects.
The Application Authority may establish special systems and programs to regularize the provision situations in which the responsible person does not have the respective license, taking into account, to that end, the particular situation of each involved player, securing the continuity of the TIC Services provision, without that meaning a remediation of any irregular situation.
ARTICLE 94.- Providers of the Basic Telephonic Service, whose license has been granted in the terms of Executive Order No. 62/90 and items 1 and 2 of article 5 of Executive Order No. 264/98, as well as those Providers of Mobile Telephone Services with license granted according to the bidding terms and conditions approved by the former MINISTRY OF ECONOMY AND PUBLIC WORKS AND UTILITIES Resolution No. 575/98 and ratified by Executive Order No. 146/193, may only provide the radio broadcasting services by subscription, through a physical link and/or radio electric link, TWO (2) years following January 1, 2016. The ENACOM may extend such term for ONE (1) more year.

Jury Duty Leave
The Company encourages all employees to fulfill their civic responsibilities and to respond to jury service subpoenas, attend court for prospective jury service or serve as a juror. Under no circumstances will employees be terminated, threatened, coerced, or penalized because they respond to a jury service subpoena, attend court for prospective jury service or serve as a juror.
Employees must provide their supervisor with notice of any jury summons or subpoena within a reasonable amount of time after receipt and before their appearance is required. Verification from the court clerk of having served may be required.
Time spent engaged in attending court for prospective jury service or for serving as a juror is not compensable except that exempt employees will not incur any reduction in pay for a partial week's absence due to jury duty. Employees who are absent from work while participating in the jury selection process or while serving as a juror will not be asked or required to use any annual, vacation or sick leave during the absence.
Time Off to Vote
The Company encourages all employees to fulfill their civic responsibilities and to vote in public elections. Most employees’ schedules provide sufficient time to vote either before or after working hours.
Employees that have less than three hours outside of working hours to vote while the polls are open may take up to three hours off from work, without loss of pay to vote. Any additional time off will be without pay for nonexempt employees.

Licencia por servicio de jurado
La compañía incentiva a los empleados a cumplir con sus responsabilidades civiles, a responder a las citaciones de servicio de jurado y a asistir al tribunal en el caso prospectivo de servicio de jurado o como miembro del jurado. En ninguna circunstancia, los empleados serán desvinculados, amenazados, coaccionados o sancionados por responder a las citaciones de servicio de jurado, asistir al tribunal debido a un servicio de jurado prospectivo o para servir como miembro del jurado.
Los empleados deberán notificar a su supervisor en caso de recibir una citación para servicio de jurado en un plazo razonable a partir de la fecha de recepción y antes de la comparecencia. Se podrá solicitar una acreditación del secretario del tribunal de la participación.
El tiempo destinado a asistir al tribunal en el caso prospectivo de servicio de jurado o como miembro del jurado no será remunerado, excepto en los casos de los empleados exentos, quienes no tendrán una reducción salarial por tomarse una licencia parcial semanal para prestar servicio de jurado. No se le requerirá a los empleados que se ausenten del trabajo mientras participan en un proceso de selección de jurado o mientras prestan servicio como miembro del jurado que utilicen licencia anual, vacaciones o licencia por enfermedad durante su ausencia.
Licencia para votar
La compañía incentiva a todos los empleados a cumplir con sus responsabilidades civiles y a participar en las elecciones públicas. La mayoría de los horarios laborales de los empleados brindan el tiempo suficiente para que puedan votar antes o después de la jornada laboral.
Los empleados que tengan menos de tres horas fuera del horario laboral para ir a votar mientras las urnas estén abiertas podrán tomar una licencia de hasta 3 horas para ir a votar sin sufrir un descuento salarial. Cualquier día no trabajado adicional será sin goce de sueldo para empleados no exentos.
