8.1.APERTURA DE CUENTAS BANCARIAS
La Fiduciaria procederá a tramitar la apertura de las cuentas bancarias (ahorros o corrientes), necesarias para el manejo de los recursos y pagos solicitados por el Fideicomitente. Cuentas bancarias donde se administrarán los recursos recibidos del Patrimonio autónomo . Las cuentas bancarias serán a nombre de , de acuerdo con las necesidades que identifique la Fiduciaria. (Anexo A. cuentas bancarias actualizadas).
Dentro de estas cuentas se incluirá(n) la(s) cuenta(s) pagadora(s) que deberá(n) marcarse como exenta(s) del Gravamen al Movimiento Financiero (GMF) por parte de la Dirección del Tesoro del Ministerio de Hacienda y Crédito Público.
A través de las cuentas se posibilitará la identificación inmediata del nombre de la persona natural o jurídica que transfiera y/o consigne; el valor recaudado; el concepto del respectivo ingreso y el contrato o convenio en virtud del cual se reciben los recursos.
Para los efectos del presente numeral se abrirán cuentas de reintegros referenciadas.
En estas cuentas se administrarán transitoriamente los recursos recibidos por EL FIDEICOMISO, en especial los recibidos en desarrollo de los convenios especiales de cooperación celebrados por éste, así como por concepto de reintegros realizados en virtud de la no ejecución de recursos por parte de los beneficiarios de los proyectos a ejecutarse en desarrollo de la contratación derivada. Los recursos recibidos en las cuentas deberán ser trasladados al portafolio del FIDEICOMISO una vez se encuentren disponibles de acuerdo con las estrategias de inversión vigentes.
La Fiduciaria emitirá comunicación oficial informando al Fideicomitente la apertura y cierre de las cuentas bancarias, para lo cual adjuntará la certificación bancaria correspondiente.
La relación de las cuentas bancarias se detalla en el anexo N° A, del presente manual, el cual será actualizado cada vez que haya un cambio, el anexo en mención será firmado por el coordinador del fondo y el representante legal de la Fiduciaria.
Translation - English 8. FINANCIAL MANAGEMENT
8.2.OPENING OF BANK ACCOUNTS
The trustee shall process the opening of the (current or savings) bank accounts needed to manage funds and payments requested by the trustor. These banking accounts shall hold sums received from the trust assets of . The bank accounts shall be in the name of , in accordance with whatever requirements the trustee may find. (Appendix A. current banking accounts).
These accounts shall include a/some payment account(s) that is/are to be registered as exempt from the tax on financial transactions (GMF) by the treasury department of the Ministry of Finance and Public Credit.
These accounts shall make it possible to immediately identify the individual or legal entity transferring and/or consigning a payment; the amount received; payment details, and the contract or agreement under which the funds are received.
For the purposes of this subsection, reimbursement-referenced accounts shall be opened.
These accounts shall temporarily hold amounts received by THE TRUST, in particular those sums received as part of the development of special cooperation agreements THE TRUST enters into, as well as reimbursements made in cases where funds were not used by beneficiaries of projects to be carried out in performing contracts derived from the aforementioned agreements. Funds received in these accounts shall be transferred to the TRUST’S portfolio once they are deemed available in accordance with current investment strategies.
The trustee shall serve official notice on the trustor, informing them of the opening and closing of bank accounts and providing the corresponding bank certifications.
The list of accounts is detailed in appendix No. A of this handbook, and shall be updated every time there is a change. Said appendix is to be signed by the fund coordinator and the legal representative of the Trust.
