Source text - English LOAN AGREEMENT
1. Parties: The undersigned is XXXXXX, the "BORROWER", and XXXXXX is the "LENDER".
2. Date of Agreement: 12/12/20XX.
3. Promise to Pay: Within 12 months from January 20XX, BORROWER promises to pay to LENDER the amount of $ XXX,XX (XXX Dollars) plus interest as well as other charges avowed below.
4. Accountability: Although this agreement may be signed below by more than one person, each of the undersigned understands that they are each as individuals responsible and jointly and severally liable for paying back the full amount.
5. Repayment: BORROWER will repay the amount of this note plus interest in 12 monthly installments on the 20 day of each month starting on January, 20XX, and ending on December, 20XX.
6. Late charge: Any payment not remunerated within 10 (ten) days of its due date shall be subject to a belatedly charge of 2% of the payment.
Translation - Portuguese CONTRATO DE MÚTUO
1. Partes interessadas: assinam este contrato XXXXXX, como “MUTUÁRIO” e XXXXXX, como “MUTUANTE”.
2. Data do contrato: 12/12/20XX.
3. Forma de pagamento: em 12 meses a partir de janeiro de 20XX, o MUTUÁRIO se compromete a pagar ao MUTUANTE a quantia de US$ XXX,XX (XXX dólares) acrescidos de juros, assim como quaisquer outras custas declaradas abaixo.
4. Responsabilidades: apesar de este contrato ser assinado abaixo por mais de uma pessoa, cada um dos signatários entende que são responsáveis tanto individual como solidariamente pelo pagamento do valor total.
5. Forma de pagamento: o MUTUÁRIO deverá pagar o valor total deste contrato acrescidos de juros em 12 parcelas mensais no dia 20 de cada mês começando em janeiro de 20XX e terminando em dezembro de 20XX.
6. Pagamentos em atraso: qualquer pagamento feito com mais de 10 (dez) dias de atraso do seu vencimento estará sujeito multa de 2% (dois por cento) do valor total do pagamento.
