Source text - Turkish Yazılan müzekkere üzerine Asayiş Şube Müdürlüğü tarafından yapılan araştırma sonucunda şüphelinin ikamet adresinin KANADA olduğu anlaşılmakla,
Şüpheliye isnat edilen hakaret suçu uzlaştırmaya tabi suçlardan ise de; CMK’nun 253/6 maddesinin Resmi mercilere beyan edilmiş olup da soruşturma dosyasında yer alan adreste bulunmama veya yurt dışında olma ya da başka bir nedenle mağduru suçtan zarar görene, şüpheliye veya bunların kanuni temsilcisine ulaşılamaması halinde, uzlaştırma yoluna gidilmeksizin soruşturma sonuçlandırılır” AMİR hükmü gereğince uzlaştırma yoluna gidilmemiştir.
Bu suretle soruşturma evresi sonunda toplanan delillerin, suçun işlendiği hususunda yeterli şüphe oluşturduğu tüm soruşturma evrakı kapsamı ile anlaşıldığından,
Sonuç ve İstem:
1-Şüphelinin atılı suçtan yargılanmasının yapılarak eylemi sabit kabul edildiği taktirde şüphelinin eylemine uyan 5237 Sayılı TCK’nun 125/1-2-4 maddelerine göre cezalandırılmasına,
2-Şüpheli hakkında TCK’nun 53 maddesindeki güvenlik tedbirlerinin uygulanmasına karar verilmesi kamu adına iddia ve talep olunur.

Although the alleged crime towards the suspect is subject to the law of settlement, because of article 253/6 of Code of Criminal Procedures that states “If the victim, the sufferer of a crime, the suspect or the legal representatives of such persons are not located in the address that is communicated to the official bodies which is within the investigation file of prosecution, are out of the country or for some reason are not in the address mentioned afore, the hearing shall be finalized without the means of settlement” thus the settlement method was not able to be implemented due to this GOVERNING provision;
As a result since the evidence collected during the. Hearing suggest that there is enough doubt that the relevant crime was committed from the whole of the hearing file scope,
Result and Demand:
1- Thus, claim and demand is made on behalf of the public, to forward the proceedings in your court for the suspect and to penalize the suspect with a punishment suitable for the act as per articles 125/1-2-4 of Turkish Penal Code with law number 5237,
2 - To Bereft from the Suspect from Use of Certain Rights that is stipulated by Article 53 of Turkish Penal Code with Law No.5237.
