How can all these reforms be scaled up so that developing countries will have a chance of meeting the Millennium Development Goals? First, as noted at the beginning of this Report, additional resources—external and internal—will be needed to capitalize on these reforms. Second, these reforms must be embedded in a public sector responsible for ensuring poor people’s access to basic services. This means that the sectoral reforms must be linked to ongoing (or nascent) public sector reforms in such areas as budget management, decentralization, and public administration reform. It also means that a well-functioning public sector is a crucial underpinning of service delivery reform. In the same vein, there should be reform in donor practices—such as harmonizing procedures and making more use of budget support—to strengthen recipient countries’ efforts to improve service outputs
Third, a recurring theme in this Report is what information can do—as a stimulant for public action, as a catalyst for change, and as an input for making other reforms work. Even in the most resistant societies, the creation and dissemination of information can be accelerated. Surveys of the quality of service delivery conducted by the Public Affairs Centre in Bangalore, India, have increased public demand for service reform.
The surveys have been replicated in 24 Indian states. The public expenditure tracking survey in Uganda is another example, as is the Probe report on India’s education system.

The second concept in international water law relevant to this discussion is known as “do no harm,” meaning that upstream countries cannot drastically harm the water of downstream countries. Harm could result from pollution or from damming up the river and preventing a needed flow of water from reaching those countries.

The concept of timely notification has strong roots in international law, being part of the 1992 Rio Declaration and the U.N. Watercourses Convention.163 Using modern engineering, river managers are capable of planning and preventing harms from occurring if they have adequate time to prepare. However, absent warning, a sudden change in the river could result in many hardships for a co-riparian state.
The ICJ discussed timely notification in the Gabcikovo-Nagymaros Project case. The court ruled that each time a state party wishes to undertake projects utilizing a water resource, that nation needs to provide other basin states with notification of their plans in a timely manner.The state party is obligated to provide such “data and information” so that the other states can make an assessment of the impact of its actions.164 If it seems likely that great harm will occur as a result of these actions, then other riparian countries will have time to lodge a complaint with the ultimate goal of finding a workable solution for both parties.
3. Basin-Wide Management
The final international water law concept this Note discusses is the principle that nations should organize the river system management on a basin-wide scale. The historical evolution of human ingenuity and the increasing need to provide water for populations dependent on the river have led to the increasing support for treating the river basin as a single unit for the management of resources.166 A number of international actions have spurred this evolution in international water law. These actions include the U.N. Secretary General Dag Hammarskjöld recognizing the basin concept in 1956 and the International Law Association stating that river basins should be “treated as an integrated whole” and not broken up “piecemeal.”
