Source text - Spanish El principio mismo de invasiones de terrenos constituye en Perú, y principalmente en Lima desde el año 1940, una forma corriente de Asentamiento Humano para las categorías menos pudientes de la sociedad que no pueden llegar al mercado inmobiliario convencional. Los Asentamientos Humanos precarios o Pueblos Jóvenes representan en mayor porcentaje el parque inmobiliario de Lima y constituyen la forma mas dinámica y mas generalizada del desarrollo de la capital. Sin embargo, estos procesos se han tenido lugar hasta ahora, dentro de marcos conflictivos y a menudo desordenados.
La imagen de Lima Metropolitana es producto de un proceso histórico. Hasta la década del 40 el espacio urbano se mantuvo casi estable, con predominio del uso residencial y poca presión sobre el suelo urbano. Los cambios operados en ella no responden a una orientación única, pero tampoco son espontáneos, responden a la lógica de las diversas fuerzas económicas y sociales actuando sobre un escenario concreto, a través de los sectores urbanos. La intensificación del proceso migratorio, acompañado por la incapacidad distributiva de la economía y del incremento demográfico vegetativo, aceleraron la demanda sobre el suelo urbano, generando mecanismos ilegales por parte de los sectores sociales de menores ingresos que desbordaron la normatividad existente. El crecimiento de los sectores urbano periféricos de la Ciudad de Lima, denominados según su ubicación geográfica: Cono Norte, Cono Sur y Cono Este, producidos a partir de un modelo informal de ocupación del suelo es muy dinámico en la metrópoli.
En estos Conos un alto porcentaje de los grupos sociales de menores recursos, han ocupado precariamente los terrenos eriazos y laderas de cerros con escaso valor comercial, sin infraestructura urbana, solo con ingenio, paciencia y organización propia han sabido transformar aplicando sus contados recursos estos terrenos de topografía difícil en nuevas áreas urbanas y han invertido en la edificación de su vivienda que generalmente es precaria, con limitación espacial de la vivienda, y no propiedad de la tierra.
Las políticas oficiales han tenido tendencia a descuidar esta forma de desarrollo de la ciudad, hasta que la presión de sus habitantes para la instalación de servicios e infraestructura y la legalización de la propiedad les obliga a preocuparse.
Hasta el año 1,984 la inversión publica por parte del Gobierno Central y las Municipalidades consistió en la ejecución de proyectos de mejoramiento de vías de transporte y mayores oportunidades de viviendas para un sector medio- alto ejecutándose por ende la construcción de grandes conjuntos residenciales. Luego en el quinquenio 1,985- 1,990 toma importancia la necesidad de tener una infraestructura mejorada y ampliada en salud, educación agua, desagüe, energía, ejecutada principalmente en los Pueblos Jóvenes.
En cuanto al problema de legalización de la propiedad en los Asentamientos Humanos tenemos que desde el año 1,957 hasta el año 1,996, se crearon 11 oficinas estatales diferentes encargadas de su tratamiento.
Podemos afirmar que las acciones en cuanto a la habilitación urbana en los Asentamientos Humanos ha sido muy limitada, con déficits de servicios básicos, equipamiento deficitario, desarticulación respecto a la trama urbana, insalubridad y alto riesgo, inadecuada ocupación del espacio residencial, y en cuanto a la legalización de la propiedad, los resultados esperados no colmaron las expectativas, principalmente motivados las políticas adoptadas por la voluntad política e ideológica de los gobernantes y de los partidos mayoritarios, basándose en la limitaciones de medios económicos disponibles para atacar los referidos procesos, deficiente manejo de los recursos y corrupción de funcionarios entre otros. Observándose que hasta el año 1,990 el incremento del valor de la tierra en los Asentamientos Humanos no fue significativo.
A partir del año 1990 al año 2,001, es la importancia que la voluntad política adquiere en tales situaciones principalmente en desarrollar instrumentos y esfuerzos para legalizar la propiedad y el destino de la inversión publica en la habilitación urbana para una mejor calidad de vida y una significativa mejora de la renta en los Asentamientos Humanos de Lima Metropolitana. El presente estudio hace frente a estos hechos durante los años 1990-2001. Sin incidir en otros aspectos de naturaleza sociológica y política.
Translation - English In Peru, and mainly in Lima since 1940, the practice of illegal squatting has constituted a current form of Human Settlement for the less-well-off sectors of society that cannot enter the conventional real estate market. Hazardous Human Settlements, or Young Towns, account for the largest percentage of real estate stock in Lima, and they are the most dynamic and widespread means of development in the capital. However, to date, this movement has occurred within a framework of conflict and often of disorganization.
The image of Metropolitan Lima is the result of a historical process. Until the forties, the urban space remained fairly stable, with residential use predominating and little pressure on urban land. The changes taking place in Lima were not due to one single course of action, nor were they spontaneous. They resulted from the logic of the diverse economic and social forces playing out in a concrete scenario in the urban sectors. The intensification of migration, coupled with the economy’s inability to distribute wealth evenly and natural demographic growth, accelerated the demand for urban land. These factors generated illegal mechanisms on the part of the low-income sectors of society that exceeded the capacity of the existing regulatory system. The urban areas surrounding the city of Lima are named for their geographic location: Northern Cone, Southern Cone, Eastern Cone. The growth in these sectors produced by a model of informal land occupation is quite vigorous.
A high percentage of the lower-income social groups have occupied the hazardous barren lands and hillsides with little commercial value and no urban infrastructure. With nothing but their ingenuity, patience, and their own organization, they have used their limited resources to transform these lands of difficult topography into new urban areas. They have invested in the construction of their generally precarious housing conditions in areas of limited space for housing, and without owning the land.
Official policies have had a tendency to ignore this form of city development until pressure from the city’s inhabitants to install services and infrastructure and legalize ownership forces policy-makers to notice it.
Until 1984, public investment by the Central Government and the Municipalities consisted of executing transportation route improvement projects and greater housing opportunities for the upper-middle class, resulting in the construction of large residential complexes. During the period 1985-1990, the need to have an improved and broadened infrastructure in the areas of health, education, water, sewage, and energy became more pressing. These projects were implemented mainly in the Young Towns.
As for the problem of legalizing ownership in the Human Settlements, we note that from 1957 to 1996, 11 different state offices in charge of ownership issues were created.
We believe that the actions taken to develop urban infrastructure in the Human Settlements have been very limited, with shortages of basic services and community infrastructure, a lack of coordination with the urban grid, poor health and high risk, and insufficient occupation of the residential space. Concerning legalization of ownership, results did not meet expectations. The policies adopted were motivated mainly by the political will and ideology of the majority leaders and parties in power. They faced limited economic means available to formulate these policies, poor resource management, and official corruption, among others. Note that up to 1990, the increase in land value increments in the Human Settlements was not significant.
From 1990 to 2001, we see the importance that political will takes on in these situations. Governments are mainly concerned with developing instruments and efforts to legalize ownership and with the end uses of public investment in urban infrastructure development for a better quality of life and a significant improvement in revenues in the Human Settlements of Metropolitan Lima. This study looks at the facts during the period 1990-2001. We do not cover other political and sociological aspects.

ATTENDU QUE pour des raisons techniques, SOCIÉTÉ B ne peut ériger sur sa propriété son poste mesurage moyenne tension.
ATTENDU QUE SOCIÉTÉ A détient le droit d’occuper l’immeuble connu comme étant le lot 91 Chemin Tel, cadastre du Canton C, circonscription foncière de Frontenac (ci-après nommé l’Immeuble) et qu’elle peut en permettre l’occupation par un tiers.
ATTENDU QU’il est dan l’intérêt de SOCIÉTÉ B que SOCIÉTÉ A lui permette d’occuper l’Immeuble aux fins d’installer son poste mesurage moyenne tension avec tous les équipements et infrastructures nécessairs et utiles dont notamment une ligne de distribution triphasée (poteaux, ancres, sectionneurs et conducteurs) incluant l’instrumentation de mesurage moyenne tension et bâtiment (±12m2) abritant les installations de mesurage.
ATTENDU QUE SOCIÉTÉ B a pris connaissance du Permis d’occupation relativement à l’Immeuble. Ledit Permis est joint à la présente convention pour en faire partie intégrante. Ref. Immeuble excédentaire-dossier 9.
ATTENDU QU’il est dans l’intérêt de SOCIÉTÉ A que SOCIÉTÉ B soit entièrement responsable de l’occupation de l’Immeuble, à la complète exonération de SOCIÉTÉ A.
IL EST PAR LES PRÉSENTES CONVENU QUE:
SOCIÉTÉ A permet à SOCIÉTÉ B d’occuper l’Immeuble aux conditions suivantes :
SOCIÉTÉ B accepte, sans aucune exception, toutes les conditions mentionnées audit Permis d’occupation et en conséquence SOCIÉTÉ B assume à l’entière exonération de la SOCIÉTÉ A toutes les obligations de l’occupant incluses et découlant dudit Permis d’occupation.
SOCIÉTÉ B reconnaît toutefois ne pas être titulaire dudit Permis.
SOCIÉTÉ B ne pourra, pour aucune considération, permettre que l’Immeuble soit occupé en tout ou en partie par un tiers.
SOCIÉTÉ B prendra toutes les mesures appropriées pour qu’aucune hypothèque légale de la construction ne soit publiée contre l’Immeuble et, le cas échéant, SOCIÉTÉ B fera radier sans délai telle charge, SOCIÉTÉ B est responsable envers SOCIÉTÉ A de tous frais, coûts occasionnnés et dommage subis en conséquence.
En cas de défaut de SOCIÉTÉ B, si SOCIÉTÉ A doit assumer quelque frais, coût de travaux et généralement quelque dépense que ce soit, SOCIÉTÉ B remboursera à SOCIÉTÉ A toute somme ainsi assumée et majorée de 30% à titre d’indemnité.
SOCIÉTÉ B respectera la norme « Mesurage de l’électricité en moyenne et en haute tension » qu’il déclare bien connaître.
SOCIÉTÉ B déclare s’auto-assurer.

Hereinafter referred to as COMPANY A

WHEREAS COMPANY B is a medium-voltage client of COMPANY A;
WHEREAS, for technical reasons, COMPANY B cannot erect its medium-voltage metering station on its property;
WHEREAS COMPANY A owns the right to occupy the building known as lot 91 Chemin Tel, cadaster of Canton C, Frontenac district (hereinafter referred to as the Building) and it may allow third-party occupancy;
WHEREAS it is in the interest of COMPANY B for COMPANY A to allow it to occupy the Building in order to install its medium-voltage metering station with all necessary and useful equipment and infrastructure, in particular a three-phase power distribution line (poles, anchor rods, disconnect switches, and conductors), including medium-voltage metering instrumentation and structures (±12 m2) that house the metering facilities;
WHEREAS COMPANY B acknowledges the Occupancy Permit for the Building; said permit is attached to this agreement and forms an essential component; Ref. Surplus Building-file 9;
WHEREAS it is in the interest of COMPANY A for COMPANY B to be entirely responsible for occupation of the Building, to the complete exemption of COMPANY A.
THE PARTIES AGREE THAT:
COMPANY A is allowing COMPANY B to occupy the Building under the following conditions:
COMPANY B accepts, without exception, all conditions mentioned in the Occupancy Permit and consequently, COMPANY B assumes and holds COMPANY A wholly exempt from all obligations of the occupant included in and resulting from the Occupancy Permit.
However, COMPANY B acknowledges that it is not the holder of the Permit.
COMPANY B may not allow the Building to be occupied in whole or in part for any consideration by a third party.
COMPANY B shall take all appropriate measures so that no statutory construction mortgage is placed on the Building, and, where applicable, COMPANY B shall remove such a lien without delay; COMPANY B is responsible to COMPANY A for any resulting costs, fees, or damages.
If COMPANY A must assume any fees, labor costs, and generally any expense due to the failure of COMPANY B, COMPANY B shall reimburse COMPANY A for any sums assumed with a 30% compensation added.
COMPANY B shall observe the regulation on Electricity Metering for Medium- and High-Voltage Installations, which it declares to be fully familiar with.
COMPANY B states that it is self-insured.
This agreement shall terminate ipso facto when the Occupancy Permit is ended for any cause whatsoever.
