Source text - English ARTICLE A-3 CONTRACT DOCUMENTS
A3.1 The contract shall consist of the Contract Documents. The “Contract Documents” shall include this Agreement and all Exhibits attached thereto, the General Conditions for Construction, the Project Overview and Scope of Services provided with Owner’s Request for Proposal, the Specifications, the Drawings, Addenda issued prior to the effective date of this Agreement, all Detailed Design Documents that are hereafter prepared by Design/Builder and approved in writing by Owner, any payment and performance bonds to be provided pursuant to this Agreement, additional drawings, specifications, modifications and addenda thereto issued after the date of this Agreement and approved in writing by Owner’s Representative, purchase orders, and Change Orders issued hereafter, any other amendments to this Agreement executed by Owner’s Representative, Owner’s Request for Proposal and bid inquiry documents (to the extent not inconsistent with any other Contract Document) and all documents annexed hereto as part of or incorporated by reference in this Agreement or the other Contract Documents. Documents not expressly listed above are not Contract Documents.
A3.2 If, and to the extent of, any inconsistency, ambiguity, discrepancy, or error in Contract Documents (collectively in this paragraph A3.2 as discrepancy) the Design/Builder shall immediately seek clarification from the “Owners Representative”. In the event that the ”Owners Representative” fails to clarify the discrepancy, within a reasonable time under the circumstances, the Design/Builder shall proceed with the Work and give precedence to the Contract Documents in the following order of priority:
(i) Change Orders issued pursuant to Article B15;
(ii) This Agreement, including all Exhibits, and any amendments thereto;
(iii) The General Conditions for Engineering, Procurement and Construction and any Supplementary Conditions or other Conditions with those bearing the latest date taking precedence, and any amendments thereto;
(iv) The Specifications;
(v) The Scope of Services provided with Owner’s Request for Proposals;
(i) The Schedule of Design/Builder’s Qualifications, and as accepted by the Owner, Clarifications and Assumptions; and,
(ii) The Preliminary Drawings and Specifications.
A-3.1 El Contrato consistirá de Documentos Contractuales, los cuales incluirán el presente Contrato y todos sus anexos, las Condiciones Generales de Construcción, la Visión General y el Alcance de los Servicios, junto con la solicitud de propuesta del Propietario, las especificaciones, los dibujos, los apéndices emitidos antes de la Fecha de Entrada en Vigor del presente Contrato, todos los Documentos de Diseño Detallado preparados con anterioridad a la firma del mismo por el Ingeniero y aprobados por escrito por el Propietario, los dibujos adicionales, las especificaciones, las modificaciones y sus apéndices expedidos después de la fecha de celebración de este Contrato y aprobados por escrito por el Representante del Propietario, las órdenes de compra, y las órdenes de cambio emitidas después de la celebración del presente Contrato, así como otras modificaciones al mismo llevadas a cabo por el Representante del Propietario, la Solicitud de Propuesta de éste y los documentos de investigación de la oferta (siempre que no entren en conflicto conningún otro Documento Contractual) y todos los documentos adjuntos a este Contrato como parte del mismo o incorporados a él como referencia, o cualquier otro Documento Contractual. Los documentos que no se mencionen expresamente en esta lista no se considerarán como Documentos Contractuales.
A3.2 Si y en la medida en que existiera alguna inconsistencia, ambigüedad, discrepancia o error en los Documentos Contractuales (denominados conjuntamente en este párrafo A3.2 como discrepancia), el Ingeniero buscará una aclaración por parte del Representante del Propietario. En caso de que el Representante del Propietario no aclare la discrepancia dentro de un tiempo razonable de acuerdo con las circunstancias, el Ingeniero procederá con la obra y dará prioridad a los Documentos Contractuales en el siguiente orden:
(i) Órdenes de Cambio expedidas de conformidad con el Artículo B15.
(ii) El presente Contrato, incluyendo todos sus Anexos y cualquier modificación a los mismos
(iii) Las Condiciones Generales de Ingeniería, Prócura y Construcción, así como cualesquiera otras condiciones complementarias u otras condiciones con aquellas que llevan la última fecha y que son prioritarias, y cualesquiera modificaciones hechas a las mismas
(iv) Las especificaciones
(v) El alcance de los servicios prestados con la Solicitud de Propuesta del Propietario
(vi) Los diseños y especificaciones preliminares.
