Source text - Swahili The Union wishes to address some “rumours” that are being spread around the Plants. The first “rumour” being spread is that if employees vote for the Union, those employees who are making more than the collective agreement rate will have their wages reduced. The second “rumour” is that ABC employees’ benefits will also be reduced. These are scare tactics being spread to try to convince employees to vote against the Union. There is no truth to these rumours.
1. The Employer cannot set or change employees’ wage rates on its own. The Union will be the bargaining representative for employees and if the Employer tries to reduce wages or benefits on its own this would be a violation of the Labour Relations Code. This section provides that an Employer may not “interfere with the representation of employees by a trade union”.
2. If you vote to have a Union and the Employer reduces employees’ wages or benefits, this would be a violation of the unfair labour practice sections of the Labour Relations Code which provides that no Employer can “discriminate against any person in regard to employment or any term or condition of employment” or impose any “pecuniary or other penalty” because of support for a Union.
Translation - English Muungano wa wafanyikazi ungependa kushughulikia baadhi ya “uvumi” ambao unasambazwa katika Viwanda. “Uvumi” wa kwanza unaosambazwa ni kwamba wafanyikazi wakiupigia Muungano kura, ujira wa wafanyikazi ambao kwa sasa unazidi kiwango cha makubaliano ya pamoja, utapunguzwa. “Uvumi” wa pili ni kwamba marupurupu ya wafanyikazi wa ABC pia yatapunguzwa. Hizi ni mbinu za kuwatisha wafanyikazi ili wasiupigie kura Muungano. Hakuna ukweli wowote katika uvumi huu.
1. Mwajiri hawezi kuweka au kubadilisha viwango vya ajira akiwa pekee yake. Muungano utakuwa mwakilishi wa wafanyikazi katika majadiliano na Mwajiri akijaribu kupunguza ujira au marupurupu ya wafanyikazi akiwa pekee yake, atakuwa akikikiuka kanuni ya kisheria ya Mahusiano ya Kazi (Labor relations code). Kifungu hiki kinasema kwamba Mwajiri hapaswi “kuingilia kati uwakilishaji wafanyikazi, wa muungano wa kikazi.”
2. Ukiupigia kura Muungano na Mwajiri apunguze ujira na marupurupu ya wafanyikazi, atakuwa amekiuka vifungu vinavyohusu mazoea yasiyo ya haki ya kikazi, katika kanuni ya kisheria ya Mahusiano ya Kazi, ambavyo vinasema kwamba Mwajiri yeyeote “asibague dhidi ya mtu yeyote kuhusu ajira au masharti ya kazi” au kumtoza “adhabu ya kifedha au ya aina nyingine” kwa sababu ameuunga mkono Muungano.

I have been in the translation business since 2004. I began as a news translator at a Kenyan Swahili newspaper, Taifa Leo. Since then, I have worked as a freelance translator on numerous projects of various nature. Nonetheless, because I was also working on a non-related PhD program, I had to take a minor break from translation in January of 2013. I am happy to report that I have just completed that project and I am now able to fully devote myself to translation.
