VISTOS, los autos de la causa penal 130/2007-V, para resolver dentro de la duplicidad de setenta y dos a ciento cuarenta y cuatro horas del plazo a que alude el artículo 19 constitucional, en términos del ordinal 161 del Código Federal de Procedimientos Penales, la situación jurídica de XXXX XXXX y XXXX XXXX por su probable responsabilidad en la comisión del delito previsto en el artículo 223, fracción V de la Ley de la Propiedad Industrial, en la hipótesis de apoderarse de un secreto industrial sin derecho y sin consentimiento de la persona que lo guarde o de su usuario autorizado, para usarlo, con el propósito de obtener un beneficio económico para sí; de igual modo, dentro de las setenta y dos horas a que se refiere el dispositivo constitucional invocado, en términos del ordinal referido, la situación jurídica de XXXX XXXX, por su probable responsabilidad en el comisión del delito previsto en el artículo 223, fracción V, de la Ley de la Propiedad Industrial, en la hipótesis de apoderarse de un secreto industrial sin derecho y sin consentimiento de la persona que lo guarde o de su usuario autorizado para usarlo, con el propósito de obtener un beneficio económico para sí; así como del delito previsto en el artículo 211 BIS 1, párrafo primero, del Código Penal Federal, relativo al que sin autorización provoque pérdida de información contenida en sistemas o equipos de informática protegidos por algún mecanismo de seguridad; y,
RESULTANDO:
PRIMERO. Por oficio 169/DPI“A”/2006, de ocho de septiembre de dos mil seis recibido en la Oficina de Correspondencia Común de los Juzgados de Distrito de Procesos Penales Federales en el Distrito Federal, con sede en el Reclusorio Oriente, a las catorce horas con veintitrés minutos del día once siguiente y, por razón de turno, por la oficial de correspondencia del Juzgado Sexto de Distrito de Procesos Penales Federales a las catorce horas con cuarenta y un minutos de esa fecha, la agente del Ministerio Público de la Federación titular de la Mesa V DPI “A”, de la Unidad Especializada en Investigación de Delitos Contra los Derechos de Autor y la Propiedad Industrial, de la Subprocuraduría de Investigación Especializada en Delitos Federales de la Procuraduría General de la República, consignó sin detenido la averiguación previa 123/UEIDDAPI/2005, constante de ocho tomos en original y duplicado, así como de cinco anexos originales identificados como “A”, “B”, “C”, “D”, y “E”, en la que ejerció acción penal, entre otros, contra XXXX XXXX, XXXX XXXX y XXXX XXXX, por la probable comisión del delito previsto y sancionado en los artículos 223 fracción IV (revelar a un tercero un secreto industrial) y 224 de la Ley de la Propiedad Industrial; así como contra XXXX XXXX, por la probable comisión del delito previsto y sancionado en el artículo 211 Bis 1 del Código Penal Federal (en la modalidad de al que sin autorización provoque pérdida de información contenida en un sistema o equipo de informática y protegidos por algún mecanismo de seguridad), solicitando se librara orden de aprehensión en su contra (fojas 1 a 3, tomo I, y 397 a 567, tomo VIII).

WHEREAS, having reviewed the records of criminal case 130/2007-V, for the purpose of rendering decision within the duplicity of seventy-two to one hundred forty-four hours from the term referred to in constitutional article 19, under the terms of subsection 161 of the Federal Criminal Procedures Code, the legal status of XXXX XXXX and XXXX XXXX for their presumed responsibility in the perpetration of the crime provided for in article 223, section V of the Industrial Property Law, in the supposition of taking possession of an industrial secret without the right and without the consent of the person that holds it or of its authorized user, in order to use it for the purpose of obtaining an economic benefit; likewise, , the legal status of XXXX XXXX, within the seventy-two hours referred to in the aforementioned constitutional device, under the terms of the abovementioned subsection, for his presumed responsibility in the perpetration of the crime provided for in article 223, section V of the Industrial Property Law, in the supposition of taking possession of an industrial secret without the right and without the consent of the person that holds it or of its authorized user, in order to use it for the purpose of obtaining an economic benefit; as well as the crime provided for in article 211 BIS 1, first paragraph, of the Federal Criminal Code, indicating that the lack of authorization brings about the loss of information contained in information technology systems or equipment protected by some security mechanism; and

FIRST. By official notice 169/DPI“A”/2006 of September eighth, two thousand six, received in the Common Correspondence Office of the District Courts of Federal Criminal Procedures in the Federal District, based in the Eastern Prison, at two twenty-three p.m. on the following eleventh and due to the court schedule, by the correspondence officer of the Sixth District Court of Federal Criminal Procedures at two forty-one p.m. on this date, the agent of the Federal Public Prosecutor’s Office, head of Desk V DPI “A”, of the Unit Specialized in the Investigation of Crimes Against Copyrights and Industrial Property of the Deputy Attorney General’s Investigation Office Specialized in Federal Crimes of the Federal Attorney General’s Office, filed preliminary investigation 123/UEIDDAPI/2005, with no arrest made, consisting of eight original and copied volumes, as well as five original appendixes identified as “A”, “B”, “C”, “D”, and “E”, in which criminal actions were exercised against XXXX XXXX, XXXX XXXX and XXXX XXXX, amongst others, for the presumed perpetration of the crime provided for and punished in articles 223 section IV (revealing an industrial secret to a third party) and 224 of the Industrial Property Law; as well as against XXXX XXXX, for the presumed perpetration of the crime provided for and punished in article 211 Bis 1 of the Federal Criminal Code (under the modality that the lack of authorization brings about the loss of information contained in an informational technology systems or equipment protected by some security mechanism), requesting that an arrest warrant be issued against him (pages 1 to 3, volume I, and 397 to 567, volume VIII).
