Ad §1 Anvendelse
Imellem de ovenfor anførte parter er indgået nærværende rammeaftale om køb og levering af knal-lerter efter afholdt udbud med forhandling efter forudgående udbudsbekendtgørelse og i overens-stemmelse med EU’s forsyningsvirksomhedsdirektiv. Som en option omfatter aftalen desuden ser-vice og vedligeholdelse af de indkøbte knallerter.
Aftalen beskriver SÆLGERS og KØBERS aftalevilkår, herunder forpligtelser og rettigheder.
Som bilag til aftalen er vedlagt Post Danmarks Almindelige Købsbetingelser for leverancer af stan-dardprodukter til Post Danmark fra november måned 2003. Disse betingelser vil være gældende, medmindre andet er aftalt og præciseret i nærværende aftale. KØBER har/vil, i forbindelse med dette udbud, der ligger til grund for denne aftale, indgå(et) ram-meaftale med én/flere leverandør(er) for at opnå forsyningssikkerhed. KØBER kan da, inden for hver produktkategori, vælge at indgå aftale med én/flere leverandører fordelt på én hovedleverandør og én eller flere sekundære leverandører. SÆLGER er, i forbindelse med indgåelse af nærværende aftale, valgt som hovedleverandør og/eller sekundær leverandør på de i aftalens ad §4 samt bilag 1 og 2 anførte produkter og/eller ydelser. De nærmere vilkår for hhv. hoved- og/eller sekundære leverandører er nærmere beskrevet i nærvæ-rende aftales hovedafsnit II, Særlige bestemmelser, ad § 20, hvortil henvises. Hovedleverandøren er den, der foretager alle leverancer i henhold til aftalen. Kun såfremt hoved-leverandøren misligholder aftalen, eller ikke er i stand til at levere produktet i henhold til denne, vil leverancer fra sekundærleverandøren blive aktuelt. I så fald udformes særskilt kontrakttillæg herom. SÆLGERS priser og produktdata kan optages i Post Danmarks elektroniske indkøbshåndbog. Alle Post Danmarks enheder kan koble sig på denne portal via Post Danmarks eget intranet, som kun disse enheder har adgang til. SÆLGER må ikke i markedsføringsøjemed kontakte andre enheder i Post Danmark end Indkøb. I henhold til bestemmelserne i de Almindelige Købsbetingelser af 28. oktober 2003 ad §1, stk. 2 – 4 skal SÆLGER som udgangspunkt være i stand til at kunne sende og modtage elektroniske medde-lelser, herunder sende og modtage indkøbs/salgsordre, ordrebekræftelse, forsendelsesadvis samt sende og modtage faktura elektronisk i aftaleperioden. Er SÆLGER i stand til at gennemføre elek-tronisk handel ved aftale-start, drøftes krav og vilkår vedr. opkobling og tilslutning til E-handels-pladsen m.v. nærmere mellem KØBER og SÆLGER.
SÆLGER har dog mulighed for - indtil videre - at udskyde implementering og opkobling til elek-tronisk handel efter forudgående accept fra KØBER.

Tra le sopracitate parti è stato stipulato un contratto quadro per l’ acquisto e la fornitura di motorini, avvenuto previa offerta e negoziazione , e a seguiire la pubblicazione dell' offerta in conformità con le direttive EU per quanto riguarda le imprese di pubblica utilità. Come opzione l’ accordo comprende inoltre il servizio e la manutenzione dei motorini acquistati.
Il contratto descrive le condizioni contrattuali sia per il VENDITORE che per l’ ACQUIRENTE, sia per quanto riguarda i diritti ed i doveri. In allegato all’ accordo si allegano le clausole d'acquisto generiche di Post Danmark per quanto riguarda la consegna di prodotti standard a Post Danmark a partire da Novembre 2003. Queste condizioni saranno valide almeno che non si prendano altri accordi o sia diversamente precisato nel presente contratto.
Post Danmark Leasing ha in relazione all’ offerta,che è alla base di questo contratto, stipulato dei contratti quadro con diversi fornitori, per ottenere un’ alta sicurezza d’ approviggionamento, per ade-guarsi in qualsiasi situazione alla struttura e all’ assistenza dei diversi fornitori e che quest’ ultimi ab-biano in ogni caso una relazione valevole all’ interno di Post Danmark.

In 1936 Germany with one simple gave notice to Italy of the imminent annexation of the Austrian territory reducing the importance of the alliance to a simple acceptation of the Anschluss: (the German political program of annexation of Austria).

These clear declarations of the uncomfortably close border changes….. caused the Italian government to make a defensive fortification along the northern frontiers (borders) as a technical and strategic response to the dangerous Germanic expansion projects thus the fortification of the Vallo Alpino del Littoro was realised.
The aim was“ermetici alcuni passi” to render the pass impossible to cross and to create a obstacle barrier through the penetration routes. To achieve this specific studies were elaborated and in January 1936 the Ispettorato dell’Arma del Genio promulgated the “Technical Directives relating to the study of the elements of the defensive systems”.

Nel 1936 La Germania, con una semplice lettera notificava all’Italia ,l’imminente annessione dei territori austriaci riducendo il ruolo dell’alleato ad una semplice presa d’atto dell’Anschluss:
“Qualunque possa essere la conseguenza dei prossimi avvenimenti, io ho tracciato una netta frontiera tedesca verso la Francia e ne traccio ora una , altrettanto netta verso l’Italia”.
Queste nette affermazioni dello scomodo confinante inducevano il Governo Italiano a dar forma al progetto di una linea di fortificazioni a difesa delle frontiere settentrionali quale risposta tecnica e tattica al pericoloso espansionismo delle Germania.
