Source text - English 6. Force Majeure. Neither party shall be responsible for complying with any provision of this Contract when any noncompliance is due to an act of God or any other condition reasonably beyond the control of such noncomplying party. The party relying on this provision shall give prompt notice to the other party of the event or circumstance and shall take all reasonable steps to resume performance at the earliest possible date.
7. Miscellaneous. No persons, performance or activities related to Shen Yun shall be recorded, reproduced, or transmitted from anywhere, including, but not limited to, the place of the performance, in any manner or by any means whatsoever, unless there is a specific written consent, issued officially in writing by Shen Yun, specifically permitting such recording, reproduction, or transmission. Presenter will make best effort to prevent any persons, individuals or entities, from doing so.
8. Governing Law. This Contract shall be governed by. and construed in accordance with the laws of the State of New York.
9. Invalidity. If any provision of the Contract or its application to any person or in any circumstances shall be invalid or unenforceable, the other provisions of the Contract shall not be affected by such invalidity or unenforceability.
Translation - Spanish 6. Fuerza mayor. Ninguna de las partes será responsable por el incumplimiento de cualquiera de las disposiciones del presente Contrato cuando dicho incumplimiento obedezca a un caso fortuito o fuerza mayor o a cualquier otra circunstancia razonablemente ajena al control de la parte incumplidora. La parte que invoque esta cláusula deberá notificar de inmediato a la otra parte la existencia del hecho o circunstancia invocados y adoptar todas las medidas razonables tendientes a reanudar el cumplimiento del presente Contrato a la mayor brevedad posible.
7. Disposiciones varias. Ninguna persona, presentación o actividad relacionada con Shen Yun podrá ser grabada, reproducida ni transmitida desde ningún lugar, incluido, entre otros, el lugar de la presentación, por ningún medio o en ninguna forma, salvo que exista consentimiento expreso y específico otorgado por escrito por Shen Yun que autorice dicha grabación, reproducción o transmisión. El Organizador realizará sus mejores esfuerzos para impedir que personas físicas o jurídicas lleven a cabo tales actos.
8. Ley aplicable. El presente Contrato se regirá e interpretará de conformidad con las leyes del Estado de Nueva York.
9. Nulidad parcial. Si alguna disposición del presente Contrato, o su aplicación a cualquier persona o en determinadas circunstancias, fuera declarada inválida o inexigible, las restantes disposiciones del presente Contrato no se verán afectadas por tal invalidez o inexigibilidad.
