Esto no habla de incumplimiento sino del no hacer cumplir, o ejecutar, algún término del contrato. Es decir, que si una de las partes no cumple en algo, y la otra lo deja pasar, eso no implica que pierde sus derechos futuros a hacer cumplir el contrato.
