: Yes. The key notion is that of the risk of being the subject of legal action. "On pain of" works in literaray and some contexts but a more common solution if the "failing which" construction. "To be held... liable" is the go-to here. "Under the law".

: This is clear but not legalesy enough, tending, dare I say it, to being a little translationesy ("under penalty of"). "Être poursuivi" is not necessarily in ref to a criminal matter. "To be held personally liable" under the law is what this is about.

Upon second thought, I must admit I like Adrian MM's rendition of "sous peine de" as "failing which"
Discussion
For the record, "être poursuivi" is not restricted to criminal proceedings. It describes the fact of taking legal action, here of having legal action taken out against X. This is about being held personally liable under the law. That liability may be in civil or criminal. The source does not specify which at this point. The terms "prosecute" and "prosecution" are indeed with reference to criminal matters but this is not mentioned here. ;-)
