Instructions about a person’s available legal remedies
As against this order, a person can immediately lodge an appeal or complaint (in the following called as “Appeal”).
The appeal has to be made and lodged with
the Magistrate’s Court Stuttgart, Hauffstrasse 5, 70190 Stuttgart
within a period of two weeks.
The appropriate time limit begins with the promulgation of notification, or when it is not terminated, with the service of process, viz. with the effective public announcement in accordance with § 9 of Insolvency Code in internet (www.insolvenzbekanntmachungen.de). The public announcement is a sufficient proof in satisfaction of the service of process to all the affected parties, even if the Insolvency Code prescribes a special mode of the service of process, § 9 par. 3 InsO. It is considered legally cancelled after further two days of the date when the announcement is made, § 9 par. 1 clause 3 of InsO. For purpose of the beginning of the notice period, the occurrence of the happening (promulgation, service of process or the legally applicable announcement to public) will be considered material.
The appeal has to be submitted in written form, or a declaration (assertion) according to the protocol in the place of business of the specified court. It can also be submitted in places of business of every other Magistrate’s court as per protocol; however the compliance of the deadline will be considered legally valid when the protocol is reached to the above mentioned court in time. Involvement of an attorney for this purpose is however not prescribed.
The application has to be signed by the person making the appeal, or their authorized representative.
The notice of appeal must contain the description of the contested order and also the explanation that the appeal is submitted against the order.
