Le nombre de dossiers déposés explose. Longtemps, ce drame n’a touché que les Français le plus précaires. Aujourd’hui, n’importe quel « accident de la vie » chômage, divorce, maladie, peut nous faire basculer dans le gouffre des dettes.
Ce mardi après-midi, à Paris, au 2e étage escalier F du Palais de justice, il y a audience au tribunal de grande instance. La juge d’exécution œuvre, blonde, discrète, précise, attentive et pédagogue. Entre ses main selle tient la vie et la mort. Comprenez la recevabilité ou le rejet d’un des quelque 180,000 dossiers atterris cette année dans le s 108 commission de surendettement françaises. La recevabilité, c’est la petite lumière que s’allume tout à coup au bout du tunnel ; la certitude que le parapluie du plan de redressement à l’aimable ou de la procédure de rétablissement personnel (PRP) - en clair, la faillite civile - va, enfin, s’ouvrir. Le rejet, c’est le retour aux ténèbres ; l’impression que le rat est condamné à tourner sans fin dans sa cage. De fait, le jugement, est sans appel. Ou quasiment. Oubliez la Cour de cassation et ses cinq ans d’attente, pendant lesquels les créanciers auront tout le temps de vous dévorer tout cru.

Au-dessus de la flèche de la Sainte-Chapelle, le ciel est d’un gris de coton sale. Eteint, comme les justiciables, assis sur des chaises orange, absents, honteux. Enfermés dans leur propre histoire, telle cette jeune femme, le visage mâché par l’angoisse, les larmes aux yeux. A peine jette-t-elle, de temps à autre, un regard sur ses compagnons de chaîne, tous les bagnards des sociétés de crédit. Question : combien des députés qui ont poussé sine die l’examen du projet de loi Lagarde destiné à porter un coup d’arrêt définitif au surendettement (lire l’encadré, p. 71) ont-ils fait un petit tour par ces limbes terrestres pour écouter le tic-tac feutré d’une vraie bombe à retardement ? En 2009, de janvier à octobre, le nombre de cas déposés à la Banque de France a augmenté de 18% par rapport à la période correspondante de 2008. Et ce n’est qu’un début.

The number of cases submitted is rocketing. For a long time such problems only affected the most precariously situated people. Today in France, any “life accidents”, unemployment, divorce or illness, can push us into a downward spiral of debts.
This Tuesday afternoon in Paris in the Palais de justice, 2nd floor, stairwell F, a hearing is taking place in the High Court. The presiding judge is blond, discreet, meticulous, attentive and instructive. She holds life and death in her hands, including admissibility or dismissal of one of the 180,000 cases which have landed at the 108 French debt commissions this year. Admissibility is the pinprick of light that suddenly appears at the very end of the tunnel; the certainty that the safety net of a civil bankruptcy procedure or recovery plan will finally be spread. Dismissal means a return to uncertainty; the feeling of being left like a rat to turn in its cage ad infinitum. Indeed, it’s impossible to appeal the judgement - or almost. Forget about the final court of appeal which takes five years, during which your creditors will have all the time in the world to eat you alive.

The sky is a dirty grey above the spire of the Sainte-Chapelle. As dull and faded as those due to be tried, sitting on orange chairs, vacant and ashamed. Locked in their own experience, like one young woman, her face contorted with worry, tears in her eyes. Occasionally she briefly glances at the others like her, all of them guilty in the eyes of the finance companies. One question jumps out; how many of the MPs who indefinitely postponed examining the Lagarde bill, destined to stop excessive debt once and for all, have actually visited this limbo land to listen to the muffled tick tock of a time bomb? In 2009, from January to October, the number of cases filed at the Banque de France increased by 18% compared to the same period in 2008. And that’s just the tip of the iceberg.
