Discussion

Non-ProZ.com Sep 17, 2004:
I also know of a case being closed, but not closed down.
Aisha Maniar Sep 17, 2004:
I'm not familiar with "terminating" a case/lawsuit, although it sounds okay.
Non-ProZ.com Sep 17, 2004:
I used termination.
My translation went like this:
termination of criminal action against defendant four owing to their death.

abatement

This is the term to be used when a criminal proceeding is "closed/cancelled/called-off", due to the death of the defendant. In case anyone was wondering, "dismissal" is inappropriate, because it implies that the proceeding was unfounded ab initio.

As for "termination", though it sounds OK (as Aisha pointed out), it cannot replace the more accurate term; i.e. "Abatement".

drop; cancel; call off

i think in the sense of "case dropped or cancelled"

the Court has ruled in presence (of defendants) to drop the criminal case against the fourth defendant due to his demise.
Peer comment(s):

agree ArabInk : drop is definitely used colloquially and journalistically, but I think there's a technical legal term the Court would use.

agree ArabInk : OK, this is definitely the correct legal term. I think. Look up "dismissal" at http://dictionary.law.com/default2.asp?selected=539&bold=||||
